Terms of Service

These terms govern your use of baperformance.com (the “Site”), operated by BA Performance Strategies LLC. By using the Site you agree to them. If you do not agree, do not use the Site.

These terms cover the Site itself. Services we deliver to clients are governed by a separate signed agreement, which controls if the two ever conflict.

Use of the Site

You agree not to:

  • Submit false, misleading, or third-party information through our forms without authorization.
  • Use the Site to send spam, or attempt to probe, scan, or breach its security.
  • Scrape, harvest, or bulk-download content except as a search engine operating within our robots.txt.
  • Interfere with the Site’s normal operation or availability.

Submissions and applications

When you submit an inquiry, book a call, or apply for a role, you confirm the information is accurate and that you have the right to share it. Files you upload — including résumés and cover letters — are handled as described in our Privacy Policy. Submitting an application does not create an employment relationship or a promise of one.

SMS terms

If you provide your phone number in a form on this Site or when booking a call, you agree that BA Performance may text you about that request.

  • What we send: appointment reminders for calls and interviews, and replies from our team about your inquiry or job application. We do not send marketing or promotional text messages.
  • How often: message frequency varies and depends on your conversation with us.
  • Cost: we do not charge for these messages, but message and data rates may apply from your mobile carrier.
  • Opting out: reply STOP to any message and we stop texting that number. Reply HELP for help, or write to contact@baperformance.com.
  • Delivery: messages may be delayed or undelivered for reasons outside our control, such as your carrier or your device. Carriers are not liable for delayed or undelivered messages.

Intellectual property

The Site, its content, and its branding are owned by BA Performance Strategies LLC or its licensors and are protected by intellectual property law. You may view and print pages for your own evaluation of our services. You may not otherwise reproduce, republish, or create derivative works without our written permission.

Third-party services and links

The Site embeds and links to third-party services, including our scheduling calendar. We do not control those services and are not responsible for their content, availability, or practices. Your use of them is governed by their own terms.

No professional advice

Content on the Site, including blog posts, is general information about outsourcing and sales operations. It is not legal, tax, employment, or financial advice, and you should not act on it without consulting a qualified professional about your situation.

Disclaimers

The Site is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

Metrics and outcomes described on the Site reflect results achieved by specific clients under specific conditions. They are not a guarantee or prediction of the results you will get.

Limitation of liability

To the fullest extent permitted by law, BA Performance Strategies LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising out of your use of the Site. Our total liability relating to the Site will not exceed one hundred US dollars (US$100).

Indemnification

You agree to indemnify and hold harmless BA Performance Strategies LLC and its officers, employees, and agents from claims and expenses arising out of your misuse of the Site or your breach of these terms.

Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Pinellas County, Florida.

Changes

We may update these terms. Changes take effect when posted, and the “last updated” date above will reflect them. Continued use of the Site after a change means you accept the revised terms.
