Privacy Policy
Last updated:
BA Performance Strategies LLC (“BA Performance”, “we”, “us”) operates baperformance.com. This policy explains what personal information we collect through this website, why we collect it, who we share it with, and the choices you have.
Information we collect
Information you give us
- Contact and inquiry forms: name, email address, phone number, company, country, and anything you write in a message field.
- Job applications: name, email address, messaging handle, country, language proficiency, roles of interest, the résumé or cover letter file you upload, and any video link you submit.
- Discovery call bookings: the name, email, and scheduling details you enter into our booking calendar.
Information collected automatically
- Usage data: pages viewed, referring URL, approximate location derived from IP address, browser and device type, which buttons you click, how far you scroll, and how you move through our forms (which fields you complete and where you stop). We record the names of the form fields you use, not what you type in them.
- Attribution data: campaign parameters in the URL you arrived with (for example
utm_source,utm_campaign,gclid,fbclid), stored so we can tell which marketing efforts work. - Cookies and similar technologies: used for analytics, marketing attribution, measuring our advertising, and spam prevention. See Cookies below.
How we use your information
- To respond to your inquiry and schedule and hold discovery calls.
- To evaluate job applications and communicate with candidates.
- To provide, operate, and improve our services.
- To measure which marketing channels bring visitors to our site.
- To prevent spam, fraud, and abuse of our forms.
- To comply with legal obligations.
AI-assisted candidate review
We may process your CV, relevant profile information, and introduction video transcript to prepare an evaluation against a client's role requirements. Our team sets the requirements, checks and can correct the results, and approves an evaluation before sharing it with the client to whom you have been presented.
We use Anthropic to produce the evaluation and may use Deepgram for transcription when existing video captions are unavailable. These providers receive the information needed for their part of the process. The transcript is for our internal team; the client receives the approved evaluation.
This feature does not make hiring decisions automatically or assess your accent, pronunciation, face, or voice. English is estimated from the transcript. Results may be inaccurate, particularly when transcription omits or changes what you said.
To ask questions, request a correction, or opt out of AI evaluation, email hiring@baperformance.com. Opting out does not prevent you from applying or being considered. Our team records your request, removes stored transcripts used by this feature, and withdraws your AI evaluations from the client portal. Opting back in does not restore withdrawn evaluations automatically.
Text messages (SMS)
If you give us your phone number in a form on this site or when booking a call, BA Performance may send you text messages about your inquiry, application, or scheduled call — appointment reminders and replies from our team. Message frequency varies. Message and data rates may apply. Reply STOP to any message to opt out, or HELP for help.
We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes. Your phone number and your consent to be contacted are used only to reach you about your own request, and are shared solely with the providers that deliver those messages on our behalf, listed under Who we share information with.
Legal bases (EEA and UK visitors)
Where the GDPR or UK GDPR applies, we rely on: your consent (analytics and advertising cookies, session recordings, marketing communications), which we ask for before setting those cookies; performance of a contract or steps taken at your request (responding to inquiries, processing applications); our legitimate interests (site security, spam prevention, understanding how our site is used); and compliance with legal obligations.
Who we share information with
We do not sell your personal information. We share it with service providers who process it on our behalf under contract:
- HighLevel, Inc. (GoHighLevel / LeadConnector) — our CRM and scheduling platform. Form submissions and booking details are stored there.
- Vercel Inc. — website hosting and file storage for uploaded résumés.
- Cloudflare, Inc. — content delivery and bot / spam protection on our forms.
- Google LLC — website analytics (Google Analytics) and the tool we use to manage the measurement tags on this site (Google Tag Manager).
- Microsoft Corporation — Microsoft Clarity, which records how visitors scroll, click and move through our pages (heat maps and session replays) so we can improve them. What you type into our forms is masked and not recorded.
- Meta Platforms, Inc. — measurement of our advertising on Facebook and Instagram, through the Meta Pixel.
We may also disclose information where required by law, to enforce our agreements, or in connection with a merger, acquisition, or sale of assets.
Cookies
Strictly necessary cookies keep the site secure and our forms functional; these cannot be turned off. We also use Google Analytics to understand how the site is used, and we store the campaign parameters you arrived with so we can tell which marketing efforts work.
We use Microsoft Clarity to see, in aggregate and through masked session replays, how people use our pages and forms, so we can improve them. It sets its own cookies; what you type into our forms is not recorded.
We also use the Meta Pixel, an advertising tool from Meta Platforms, Inc. It sets cookies and tells Meta which pages you visit on this site and when you send a form, so we can measure how our ads on Facebook and Instagram perform. Meta may combine this with information it already has about you and use it for ad delivery under its own privacy policy.
Your choice. If you visit from the European Economic Area, the United Kingdom, or Switzerland, we ask for your consent before setting analytics or advertising cookies; until you choose, they stay off. Wherever you are, you can change your choice at any time with the “Cookie settings” link at the bottom of every page. You can also clear or block cookies in your browser settings, install the Google Analytics opt-out browser add-on, or change how Meta uses this information in your Meta ad preferences, though parts of the site may stop working correctly if you block cookies entirely.
International transfers
We are based in the United States and our service providers may process data in the United States and other countries. Where we transfer personal information out of the EEA or UK, we rely on Standard Contractual Clauses or another lawful transfer mechanism.
Retention
We keep inquiry and client contact records for as long as needed to serve the relationship and to meet legal, tax, and accounting obligations. We keep unsuccessful job applications for up to 24 months so we can consider you for future openings, unless you ask us to delete them sooner.
Your rights
Depending on where you live, you may have the right to access, correct, delete, or receive a copy of your personal information; to withdraw consent; to opt out of targeted advertising or the “sharing” of personal information; and to appeal a refused request. California residents have these rights under the CCPA/CPRA, and we will not discriminate against you for exercising them.
To make a request, email contact@baperformance.com. We may need to verify your identity before acting.
Children
This site is not directed at children under 16, and we do not knowingly collect their personal information.
Security
We use technical and organizational measures appropriate to the risk, including encryption in transit and access controls on our CRM. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Changes to this policy
We may update this policy. When we do, we will revise the “last updated” date above, and for material changes we will provide additional notice.
